1. General

These Terms of Service ("Terms") apply to the use of the Pebble for Pets website and to all purchases made through our online store.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or place an order.

These Terms apply to consumers and other customers purchasing products through our online store. Where mandatory consumer protection laws apply, nothing in these Terms is intended to limit those statutory rights.


2. Our Products

Pebble for Pets offers curated pet products, including products for dogs and other pets.

We make reasonable efforts to ensure that product descriptions, photographs, colours, dimensions and other information displayed on our website are accurate. However, colours may appear slightly different depending on your device or screen settings.

Minor variations in colour, texture, finish, dimensions or appearance may occur and do not necessarily constitute a defect where the product otherwise corresponds with its description.

You should always read the product description, specifications and care instructions before purchasing a product.


3. Product Safety and Use

Our products are intended to be used only for their stated purpose and in accordance with any instructions or warnings provided with the product.

Pet products should be used under appropriate supervision where reasonably necessary.

You are responsible for selecting products that are appropriate for your pet and for using them correctly.

Pebble for Pets is not responsible for damage resulting from misuse, improper use, failure to follow product instructions, normal wear and tear, or use of a product for a purpose for which it was not designed.

If a product appears damaged, defective or unsafe, discontinue use and contact us as soon as possible.


4. Product Availability

All products are subject to availability.

We reserve the right to limit quantities or discontinue products at any time.

If you place an order for a product that subsequently becomes unavailable, we will inform you and refund any amount already paid for that product.


5. Prices

All prices displayed on our website are shown in euros (€).

Where applicable, prices include VAT.

Any delivery charges or other additional costs applicable to your order will be displayed before you complete your purchase.

We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted by us.

In the event of an obvious pricing or technical error, we reserve the right to correct the error. If an order has been placed based on an obvious error, we will contact you before processing the order and, where required, provide you with the option to cancel the order.


6. Orders and Formation of the Contract

When you place an order through our website, you are making an offer to purchase the selected products.

After placing an order, you will receive an order confirmation by email. The order confirmation confirms that we have received your order but does not necessarily mean that the order has been accepted if we are unable to fulfil it.

A purchase agreement is formed when we accept your order and/or dispatch the products, subject to applicable law.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including suspected fraud, an obvious pricing error, technical error, product unavailability or an inability to deliver to the requested destination.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order.


7. Payment

Payment must be completed using the payment methods made available at checkout.

You agree to provide accurate and complete payment and billing information.

If payment is unsuccessful, we may suspend or cancel the order until payment has been successfully completed.


8. Delivery

We will deliver your order to the delivery address provided during checkout.

Available delivery destinations, shipping methods, estimated delivery times and applicable shipping charges are described in our Shipping Policy.

Delivery times shown on our website are estimates unless expressly stated otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, strikes, severe weather, customs procedures or other events beyond our reasonable control.

If an order is delayed or appears to be lost, please contact us at contact@pebbleforpets.com so that we can assist you.

Risk of loss or damage to the products passes to you when you, or a third party designated by you other than the carrier, physically receives the products, except where applicable law provides otherwise.


9. Right of Withdrawal – 14-Day Cooling-Off Period

If you are a consumer purchasing products online, you generally have a statutory right to withdraw from your purchase without giving a reason.

The withdrawal period is 14 days from the day after you, or a third party designated by you, receives the product.

If your order consists of multiple products delivered separately, the withdrawal period generally begins when you receive the final product.

You may exercise your right of withdrawal by informing us clearly that you wish to cancel your purchase before the withdrawal period expires.

You do not have to provide a reason for exercising your statutory right of withdrawal.

Dutch consumer law requires online sellers to clearly inform consumers about this right and the procedure for exercising it.


10. Returning Products

After exercising your right of withdrawal, you must return the product to us without undue delay and generally within 14 days after notifying us of your withdrawal.

The product should be returned in a condition that allows us to determine whether it has been used beyond what is necessary to assess its nature, characteristics and functioning.

You may open packaging and reasonably inspect or try a product as you would in a physical store.

If a product has been handled beyond what is necessary to assess it and this results in a reduction in value, you may be responsible for that reduction in value to the extent permitted by law.

11. Return Shipping Costs

Unless otherwise required by applicable law or expressly stated by us, you are responsible for the direct cost of returning a product when exercising your statutory right of withdrawal.

This does not affect your statutory rights where the product is defective, damaged or does not conform to the agreement.


12. Refunds

When you validly exercise your right of withdrawal, we will refund the payments received from you, including the standard delivery cost charged for the original shipment.

If you selected a more expensive delivery method than our standard delivery option, we are not required to refund the additional cost of that more expensive method.

We will issue the refund without undue delay and generally no later than 14 days after receiving your withdrawal notice.

However, where permitted by law, we may wait until we have received the returned product or you have provided evidence that the product has been sent back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction, unless you expressly agree otherwise.

These rules reflect the statutory requirements for online consumer purchases.


13. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to certain products or circumstances provided by law.

Where relevant, this may include products that are made according to the customer's specifications or clearly personalised, and other statutory exceptions.

If a particular product is subject to an exception to the right of withdrawal, we will inform you before you complete your purchase.

Nothing in these Terms removes any withdrawal right that cannot legally be excluded.


14. Defective Products and Statutory Consumer Rights

We are responsible for ensuring that products conform to the purchase agreement and meet the requirements reasonably expected of them.

If a product is defective, does not correspond with its description, or otherwise fails to meet the requirements applicable under Dutch consumer law, you may have statutory rights to a repair, replacement, price reduction or refund, depending on the circumstances.

These statutory rights apply regardless of any voluntary return or warranty policy offered by us.

EU consumer rules provide a minimum level of legal protection for defective or non-conforming goods, while the exact application of Dutch statutory conformity rules depends on the circumstances of the purchase.

15. Normal Wear and Tear

Statutory rights do not generally cover damage caused by:

  • normal wear and tear;
  • accidents;
  • misuse or improper use;
  • failure to follow care or use instructions;
  • modifications or alterations made by the customer;
  • use of the product for a purpose for which it was not designed; or
  • damage caused by the customer's pet or another animal where the damage results from inappropriate or excessive use.

This section does not limit any mandatory rights you may have under applicable consumer law.

Please provide your order number and a clear description of the complaint.

We aim to respond to complaints within 14 days. If a complaint requires more time to resolve, we will inform you when you can expect a substantive response.

Dutch rules require online businesses to provide information about their complaint-handling procedure.


17. Website Use

You may use our website only for lawful purposes.

You must not:

  • use the website for fraudulent or unlawful purposes;
  • interfere with the operation or security of the website;
  • attempt to gain unauthorised access to our systems;
  • introduce viruses, malware or other harmful material;
  • reproduce or exploit website content for commercial purposes without our permission; or

We may restrict or terminate access to the website where reasonably necessary to protect our business, website or users.

All content on the Pebble for Pets website, including but not limited to text, photographs, product images, graphics, logos, designs, icons, videos, layouts and other materials, is owned by or licensed to Pebble for Pets unless otherwise stated.

You may not copy, reproduce, modify, distribute, publish, sell or commercially exploit our content without our prior written permission.

The Pebble and Pebble for Pets names, logos and branding may not be used without our prior written permission.


19. Third-Party Products and Brands

Our store may offer products from third-party brands or manufacturers.

Where a product is supplied or manufactured by a third party, the applicable manufacturer's information, instructions and warnings should also be followed.

Nothing in these Terms limits your statutory rights against us as the seller.


20. Links to Third-Party Websites

Our website may contain links to websites or services operated by third parties.

These links are provided for convenience. We are not responsible for the content, availability, security or privacy practices of third-party websites.

Your use of third-party websites is subject to the terms and policies of those third parties.


21. Personal Information and Privacy

We process personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what personal information we collect, why we collect it, how we use it, how long we retain it and what rights you may have regarding your personal information.


22. Limitation of Liability

To the maximum extent permitted by applicable law, Pebble for Pets will not be liable for indirect or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms limits your statutory consumer rights or our liability for matters that cannot legally be excluded or limited.


23. Events Beyond Our Reasonable Control

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.

Such circumstances may include, for example:

  • natural disasters;
  • severe weather;
  • strikes;
  • transport disruptions;
  • postal or courier disruptions;
  • government restrictions;
  • war or civil unrest;
  • power or internet outages;
  • cyber incidents affecting essential service providers; or
  • other circumstances that could not reasonably have been prevented or avoided.

Where reasonably possible, we will inform you of significant delays and take reasonable steps to minimise their impact.


24. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, website, legal requirements or other operational reasons.

The updated version will be published on our website and will include an updated "Last updated" date.

Changes will not affect rights arising from orders already placed unless required by law.


25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it valid and enforceable, where legally possible.

The remaining provisions will continue to apply.


26. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision later.


27. Applicable Law

These Terms and any agreement between you and Pebble for Pets are governed by the laws of the Netherlands, except where mandatory consumer protection laws in your country of residence provide you with additional rights that cannot be excluded.

If you are a consumer residing in another EU/EEA country, applicable mandatory consumer protection legislation may also apply to your purchase.


28. Dispute Resolution

If you have a dispute with us, we encourage you to contact us first so that we can try to resolve the matter amicably.

If the matter cannot be resolved directly, you retain any rights available to you under applicable consumer protection legislation, including the right to bring a claim before a competent court.

Nothing in these Terms prevents a consumer from exercising mandatory rights concerning jurisdiction or dispute resolution.
